Child Custody, Love Custody

Child Custody, Love Custody

Chapter 39

Judge Bak leaned forward & clasped his hands together. Junsu cleared his throat & tried his best to continue the unbearable trail, “Ms. Kwon. The only reason why you took yours & your ex-husband’s son away was just because of a heartbreak?”

“No, Mr. Kim. That wasn’t the only reason.” At the corner of her eyes, Yuri could see the judge heavy brow lifting. She changed position uncomfortably. She turned to look at Junsu again, but instead, met the eyes of her ex-husband. He still had on the same expression with his arms crossed over his chest. He stared back at her as this wasn’t anything big that he had gone through.

“Ms. Kwon.” Junsu said, crossing his arms over his chest as if he knew Jaejoong was in the same arm position, “& your other reason is?”

Yuri turned her gaze back to Jaejoong’s lawyer, “I didn’t want him to find out about my son.” She simply answered.

Junsu smiled but he tried not, too. This case was interesting but he was against it, “Why is that? Is it just because he cheated on you?”

She shook her head but knew she had to directly answer him in proper words, “No, not because he cheated on me. I did leave because he cheated on me but I didn’t take Hyunnie away from him because of that reason.” She took a direct stare at Jaejoong, “Most woman will want him for his money but I, Mr. Kim, search for his love but knowing that the man I love doesn’t love me anymore; I can’t live with him, not even when I’m pregnant. May I ask you a question, Mr. Kim?”

Junsu looked towards Judge Bak. The old man nodded. Yuri then smiled thinly at Junsu. Rarely can clients ask questions. Her friend was going against her with her ex-husband & she was willing to make the difference, “Tell me, will you ever cheat on your wife with a woman that you hardly know with the beauty that you had never seen before?”

Junsu rose a brow & behind him, Yuri could see Jaejoong’s brow raising in the same motion. She looked at Junsu & rose her brows, willing to win his answer. She knew Junsu well & knows that he will never cheat on Yoona. Junsu & Yoona had known each other since they were babies & still, he hadn’t gotten over his wife neither in person nor in mind but Yuri wanted to direct Junsu’s answer to her ex-husband, the man that had cheated on her with a woman that he had hardly knew with the beauty that he had never seen.

He cleared his throat, “No, Ms. Kwon. I would never cheat on my wife.”

She nodded her head & couldn’t help but stare at Jaejoong. He pushed her a glare of unfairness. She lifted her chin, willing to win this war with him. She wasn’t a hussy on the street, “Thank you. Now, you may know why we filed the divorce so quickly afterwards & why I left without telling him about my son.”

“You mean yours & Mr. Kim’s son.” Junsu corrected her. She hadn’t won him yet, “I understand your feelings. That includes sorrow but the jury doesn’t go for your tears, Ms. Kwon. Understand that.” He saw Yuri’s eyes starting to swell up with tears. Dear god, he had never meant to hurt her like that, “Have you ever threatened or abused your son?”

“No, sir.” She said strongly than ever. How dare her friend ask her that question? As much as he was Jaejoong’s lawyer, she was his friend.

He chuckled, never really wanted too, but only for his client, ‘For being such a good lawyer.’ He thought sarcastically, “Now, now, Ms. Kwon. You had already placed your hand on the bible & said ‘I would tell the whole truth & nothing but the truth’. Why lie now? We all know that parents don’t always tell the truth, especially about abusing their child.” Inside, he grimaced.

“Mr. Kim. If I said that I would tell the whole truth, I will. It’s only the lawyers & men out there that never tells the truth.” She put that directly towards every man in the room but more over to Jaejoong.

Junsu finally grimaced outside. Turning to the judge, he nodded & said, “I’m done here, your honor.”

He turned his back & walked to his seat near Jaejoong’s, “I’m going to hate you after this.” Junsu whispered to Jaejoong, & sat down with a hard bump.

Jaejoong stared at his friend, “Count me in.”

“Mr. Ok.” The judge said.

The elderly man stood up with his papers rolled. He walked halfway to the judge & gave a reassuring nod to Yuri. She smiled. Mr. Ok cleared his throat, “As it says in here, your son is three years old.” She nodded, even though it was more of a statement said from her lawyer, “As I see here, there should be no reason why Mr. Kim should take custody of her son since he knows nothing about him. I…”

“Why shouldn’t he?” Junsu stood up & interrupted, “That woman had taken her son…”

Judge Bak banged his wooden mallet two times. He threw Junsu a look. Slowly, Junsu sighed & sat back down obediently, “Proceed, Mr. Ok.”

He nodded & turned back to Yuri, “As I was saying, four years & Mr. Kim knows completely nothing about Hyunnie. Completely nothing.” He repeated, putting emphasis around his last sentence, “The little boy could be having an illness or any allergies that he wouldn’t know of.” He turned around & pointed his index finger at Jaejoong, “The young man cheated on his wife & now, he’s back just to take her son away? What kind of man is that? We call those, as Ms. Kwon had told me, deceivers. He left her with every sad emotions that you can name & he came back to take her son away just as soon as he had found out about him. What will she have left if he wins this case right now & right here, juries?” He asked, directly the question to himself but saying the jury’s name.

“Nothing, huh?” The old man was talking to himself, “The only thing that she has left in this world is her son! Don’t take him away from her! So what?! What if she didn’t tell her ex-husband that she was pregnant?! Who cares?!” He exclaimed, throwing his arms out, “The man treated her like an old shoe after he bought a new one! He didn’t care about her! What makes everyone think that he will care for the son?!”

“That!” Junsu shouted again, jumping out of his seat, “Is out of line, your honor! Mr. Kim…”

Again, the judge banged his mallet onto the wooden block, “Mr. Kim. Please have your seat.” Junsu let out a huff of breath & glared at Mr. Ok. He shrugged carelessly. Junsu his bow-shaped lips & sat down again.

Mr. Ok cleared his throat & continued his lecture, “Mr. Kim doesn’t know any experience with children. In his results, he had never had anything to do with children until now. What does he want with her son?” He nodded his head to himself, “That’s right. He just wants to take revenge of what my client had done. He doesn’t want the child. What in god’s word would he want him for? He took this into court just because of money & revenge.”

Behind Yuri’s lawyer, Jaejoong gritted his teeth in anger. If he was up there now, he had rip that old, unrighteous man into pieces. What right does he have to say that? He made never have experience with children but he loves them. The heck with money. He didn’t come here for those green dollar bills & revenge? How much does he hate that word? Never in his life had he took revenge. Maybe when he was three but this was now, he hated revenge. It was Yuri who was taking the revenge on him.

“Bull!” He hissed in a whisper to Junsu. He wasn’t going to give up yet. Yuri’s lawyer maybe great but he knew he was greater, “We will take a break after the old man is over. After that, call Hyunnie up.”

Junsu frowned, “But your son isn’t here.”

“I know.” He said, “That’s the point. Let’s see why she didn’t bring my son along.”

Now, Junsu rose his brows, “Nice.” He whispered, trying to sound enthusiastic.

“Ms. Kwon. As the birth certificate says, Mr. Kim is the father of your son.” Mr. Ok said. He walked back & forth, “If you hate him so much, why imply his name onto your son’s birth certificate?”

Yuri grimaced, “I didn’t. It was my younger sister, Mina. She thought it was right to have the proper father for my son.”

“Then why is your son’s last name isn’t Kim while it’s Kwon like yours?”

“I filled out the certificate after Hyunnie was born. My sister could erases his last name. She could had only signed my ex-husband’s name when I was sending my files to a designer.”

He nodded, “So, as I can guess, she couldn’t change the actual certificate.” He turned to look behind at Jaejoong & smiled, “That means he isn’t the father.”

“That is falses, your honor.” Junsu jumped up again.

“Mr. Kim.”

He crossed his arms, “May we have a minute up?”

The judge frowned but nodded his head. He covered the little microphone with his big palm & leaned over. Both lawyers had their arms crossed over their chest, ready to say anything, “What is it, Mr. Kim?”

“Under the circumstances, your honor, Mr. Kim is the boy’s biological father.”

“It doesn’t say so in his actual birth certificate.” Mr. Ok defended his client.

“It doesn’t have to. There’s no proof from you.” Junsu said vigorously, “We need the actual certificate to be the witness but even so, it’s just a piece of paper. The blood really counts.”

Mr. Ok grunted.

“I suggests this interruption doesn’t continue. Proceed.”

“Can we have a five minute break?” Junsu asked, before the judge can hit his huge mallet again.

Judge Bak looked towards Mr. Ok’s way. He nodded, “I’m over anyhow.”

As the mallet hit the small wooden board, Judge Bak called out, “Five minute break!”

Yuri let out a breath at the words & stepped down from the stand. Everyone started to chatter as she walked over to her lawyer, “Who called for a five minute break?”

“Mr. Kim.” Mr. Ok replied. He looked up at Yuri after stacking up his papers, “You were great up there. Don’t drop that jaw of yours. I’m sure your ex-husband won’t get a bit of your son.”

“How sure are you?” Jaejoong asked him, from behind.

Yuri averted & stared at him wide eyed, “That was very smart of you, Mr. Kim, to get Junsu to ask me such questions.” Her voice was plain but somehow, impatient with the man in front of her.

Jaejoong nodded, “Thank you.” He said with sarcasm, “I’m sure that the things I use against you in the first place of how we got here, Yuri, I can use it again.”

She frowned rudely at his confused words, “I don’t need you to mock me. Suing me is enough. If you need more, you can dig the ground up & go to blazes.”

He nodded again, but this time, he was smiling. Before he could add anything more to her words of nonsenses, her lawyer interrupted them, “I’m sure you have more important things to do than talk to my client, Mr. Kim.” He averted to Yuri, “I have words to say to you.”

Yuri nodded & walked away with a brief word to Jaejoong. Sitting down, she listened as her lawyer talked, “The certificate failed. It doesn’t matter if we need the accurate one.” He turned a few pages of his ample pile of papers, “Blood.” He said dryly, “That won’t be necessarily since everyone knows that Hyunnie is his son. We…”

The sound of the loud mallet interrupted him, “Order.” Another bang of the mallet sounded, “Order.” The room went quiet, “We will now proceed after the five minute. Mr. Kim.” He said, nodding his head towards Junsu, “Continue.”

Getting up, Junsu couldn’t help but grimace. He walked halfway up to the judge & then turned back around to face the crowd, moreover, Yuri “Your honor.” He said, after a while, “May I call up the son of Mr. Kim & Ms. Kwon, Taehyun Kwon.”
