Stand By You

At exactly two, the Bailiff called the court to order as the judge entered the courtroom. Yunho kept watch on the door as it seemed that Jaejoong was running late. After the judge rapped his gavel, they all took a seat as the judge directed Leeteuk to present their case.

 

"He'll be here. Stop worrying." Leeteuk whispered to Yunho before standing up to address the judge. "Your honor we would like to call Dr. Kwang to the stand."

 

Yunho looked to Leeteuk in surprise. How can they call the very man who caused him his brothers as his witness? Yunho was about to protest when suddenly the doors to the courtroom opened and a flushed looking Jaejoong entered. Rushing towards Leeteuk, he gave him a brown manila envelope and shared a grin with the latter.

 

"What is this interruption counsel?" The judge asked.

 

"Ah, I do apologize your honor. May we proceed?" Leeteuk asked humbly.

 

"Alright. But be warned that I do not appreciate unnecessary interruptions in my courtroom." The judge warned.

 

"Yes your honor." Leeteuk replied as Dr. Kwang took the stand.

 

"Dr. Kwang, during your last statement, you mentioned that you ran some tests on Changmin while he was at the hospital. Is that correct?"

 

"Yes, that is correct." the doctor answered.

 

"May we know what type of tests you ran doctor?" Leeteuk asked.

 

"Well, we ran standard blood tests as well as a couple of physical ability tests." the doctor answered.

 

"Ah yes, the physical ability tests. Would that be it doctor?"

 

"Yes, yes, I believe so."

 

"Are you sure doctor? I would like to remind you that you are under oath."

 

Everyone could see that the doctor physically bristled at Leeteuk's insinuation. "There might have been a few other tests here and there." The doctor answered curtly.

 

"Changmin's records show that on the day before Changmin's release, you ordered some other tests of a different nature. Did you not?"

 

"I may have." the doctor acquiescenced.

 

"Your honor may I approach the witness?" Leeteuk asked.

 

"You may." The judge stated.

 

"Is this your signature doctor?" Leeteuk asked as he showed the doctor the document.

 

The doctor took out this glasses, perched it on top of his crooked nose and looked at the document before folding his glasses in half and putting it back inside his front pocket and answered, "Yes, it appears to be so."

 

It took a lot out of Yunho not to hurl himself at the doctor from across the courtroom and smack the smug look off the doctor's face. He really was never one to resort to violence but in this case, he was about to make an exception. Leeteuk on the other hand just smiled.

 

"Your honor, I would like to submit Changmin's chart as Evidence B and the subject pages marked as Evidence B-1 for the respondents. The following shows the doctor's signature on a mental ability test for Changmin."

 

"So ordered. Proceed counsel." The judge said rapping his gavel.

 

"Doctor witness will you please inform the good court what tests you ordered to be made on Changmin the day of his release from the court which you ordered to be conducted?"

 

Once again, the doctor made a show of wearing his glasses and clearing his throat before reading the document. "I ordered a final round of blood tests, one of a complete blood count as well as a white blood cell count. I also ordered to check for the puss level in his inner ear." The doctor said.

 

"And finally doctor at the very bottom of the page, what does it say?" Leeteuk asked.

 

The doctor seemed to hesitate. Clearing his throat he finally spoke and said, "I... I ordered a mental abilities test."

 

"I beg your pardon?" Leeteuk asked.

 

"I said that I ordered for a mental abilities test to be done to the boy." The doctor replied a little too loudly.

 

"A mental abilities test, eh?" Leeteuk said his arm folded across his chest as his other hand scratched his chin. "Uh, I guess that is standard procedure for an ear infection problem, is it doctor?"

 

"It was a severe ear infection." The doctor said condescendingly.

 

"Oh, I do apologize." Leeteuk said almost in a mocking manner. "Changmin's ear infection was so severe that you ordered for a mental abilities test?" Leeteuk asked bordering on an incredulous manner.

 

Leeteuk suddenly turned around and marched back to the respondent's table and retrieved the manila envelope that Jaejoong handed him earlier. "Your honor, in my hand is a copy of Changmin's mental abilities test. We would like to submit this as Evidence C for the respondent."

 

"Bailiff please mark it accordingly. So ordered." The judge said.

 

"Thank you your honor." Turning back to the doctor, Leeteuk handed him a copy as well as the judge before opening his own copy and searching for the final pages, Leeteuk did a quick scan before saying, "If everyone can please turn to page 32 where the psychologist discusses the results of the mental abilities test?"

 

Leeteuk paused as he waited for the doctor as well as the judge to turn to the correct page. "Doctor, would you be so kind as to read for us paragraph 5." Leeteuk asked kindly.

 

Clearing his throat once again, the doctor threw Leeteuk a quick glare before reading the paragraph. "It appears that Changmin is a happy boy, one who is quiet yet highly alert. Verbally he is able to make sounds if asked to follow but would only smile when asked to say words. However, his non-verbal abilities test shows that Changmin is of a highly intelligent nature, one who is able to solve puzzles much faster than the average child of his age. Further tests at a later age may reveal a better assessment of Changmin's true abilities. But even now, it is apparent that Changmin already exhibits signs of genius."

 

Jaejoong gasped as Yunho turned and looked at him with a huge grin on his face. Leeteuk nodded his head as the doctor ended the paragraph.

 

"Doctor, may I inquire on the previous document on which you made the order for this test to be done, which nurse you ordered and signed off with?" Leeteuk asked.

 

Looking extremely uncomfortable the doctor repeatedly cleared his throat then answered, "That would be Nurse Hwang." The doctor answered.

 

"Nurse Hwang? The same nurse Hwang who said that Changmin couldn't seem to speak?" Leeteuk asked.

 

"Yes." The doctor answered.

 

"Then doctor, is this also the same nurse Hwang who has stood witness along with you on all 10 cases that you have been a witness for in the previous cases we have earlier mentioned? The cases where you reported to Child Protective Services I mean," Leeteuk clarified.

 

"Yes." The doctor replied curtly.

 

"When may I ask did you acquire a copy of the test results doctor?" Leeteuk asked.

 

Jaejoong's jaw was already hanging at how good Leeteuk was. Anyone could see that Leeteuk was carefully laying the trap and the doctor was just walking into it. Jae waited with bated breath as the doctor answered.

 

The doctor replied, "The day after I called in the report."

 

"Damn." Jaejoong flushed. He was hoping that the doctor knew the results before he called in. Still he had faith in Leeteuk who remained to look so cool.

 

"Of course." Leeteuk answered calmly. "So then, is it safe to assume that Nurse Hwang would know about the results?" Leeteuk asked nonchalantly.

 

"Well, I wouldn't..." The doctor seemed to hesitate.

 

"You don't have to answer that." Leeteuk suddenly said. "Am I correct to assume doctor that it was Nurse Hwang who first brought to your attention the fact that Changmin seemed to have problems talking?" Leeteuk asked.

 

"Well yes..." The doctor began before Leeteuk cut him off.

 

"And isn't it true doctor that since Nurse Hwang has obviously signed off on the order that she would be aware that Changmin underwent a mental abilities test."

 

"T-That would be correct." The doctor said.

 

"And so then, it would be safe to assume that because of the seemingly close nature of your professional relationship with Nurse Hwang, having served as witnesses in several cases that she would have been informed regarding the test results?" Leeteuk asked.

 

"W-Well, y-yes." The doctor stammered.

 

"And yet!" Leeteuk suddenly said surprising everyone in the court, "She knowingly took the stand and bore witness in this case that Changmin was a developmentally challenged child." Leeteuk said quietly. "Curious isn't it?" Leeteuk suddenly asked addressing the court at large before walking back to his table and giving Yunho a wink.

 

"Well... I... I..." The doctor sputtered.

 

"No more questions your honor." Leeteuk said as he took his seat a look of quiet satisfaction on his face.

"Remind me to cook you a great meal after all of this is over." Jaejoong said as he hugged Leeteuk during the break. Siwon was given time to cross examine the doctor, however, the damage has been done. Leeteuk was able to discredit Nurse Hwang's previous statements as well as further taint the doctor's credibility as witness. He was indeed quite brilliant.

 

"That would be great." Leeteuk said. "Maybe make me some of your famous Kimchi Jiggae?" Leeteuk asked hopefully.

 

"Anything you want." Jaejoong said a huge grin splitting his handsome face.

 

"He really is a keeper." Leeteuk said to Yunho who couldn't help but smile as Jaejoong blushed.

 

A bell signaled that the trial was about to resume so they all filed back into the courtroom. The judge asked for the respondent to present their next witness.

 

Leeteuk stood up and buttoned his suit before announcing, "Your honor, we would like to call Yoochun as witness for the respondent."

 

A blanket of murmurings could suddenly be heard from a few people in the courtroom. And even though Yunho was already aware that at some point Yoochun was going to have to bear witness for him, he really hoped that it wouldn't have to be necessary. However, after seeing how Leeteuk handled the situation with the doctor earlier, Yunho knew it was best to allow the man's genius to take over.

 

"Order in the court." The judge said warning the handful of others who were in the courtoom who were following the proceedings. "Go ahead counsel."

 

"Your honor, we would like to present a pre-taped conversation between Yoochun and Choi Siwon-shii." Leeteuk said.

 

Jaejoong threw Yunho a look of surprise while the latter looked at him and gave him a look of assurance. Jae nodded as he drew a deep breath while the Bailiff fixed the media player.

 

The screen flickered for a moment before Yoochun came on the screen showing him seated on a chair somewhere in the playroom of the Center while he flipped through a manga that Jaejoong brought him.

 

Siwon came on the screen as well and sat across Yoochun while a social worker could be seen taking her seat behind Yoochun. Yoochun didn't seem to notice Siwon's arrival and so the latter actually had to clear his throat to be acknowledged. Yoochun looked up at Siwon and dutifully put away his manga and looked at the man inquiringly.

 

"Yoochun, my name is Choi Siwon-shii." Siwon began.

 

"Good afternoon ahjussi*." Yoochun said with a bow.

 

Jaejoong couldn't help but smile at how Yoochun looked so smart and polite.

 

"Ah, yeah, good afternoon." Siwon replied.

 

Yoochun sat there and looked at the man curiously. He knew that Siwon was here for. He's definitely read enough mangas to know that while all appearances seemed to say otherwise, Siwon ahjussi was unfortunately not one of the good guys in this story.

 

"I'm here to ask you a few questions Yoochun okay?" Siwon asked.

 

"Does it have something to do with my brother and Jaejoong hyung?" Yoochun asked silently.

 

"Ah, well that would be correct." Siwon answered.

 

"What," Yoochun asked seemingly hesitant, "What if I don't want to answer?" Yoochun asked.

 

"Yoochun-ah, all we want is what's best for you and Changmin. The truth is, you're the only one who can tell us if your Yunho hyung is the best candidate to be your parent. Changmin is too little for us to ask and so the only way for you to help him is to answer my questions as truthfully as possible, okay?" Siwon said.

 

Yoochun's face fell. He wasn't sure if this was a good idea or not but he knew that Siwon ahjussi was right. So he took a deep breath and said, "Okay then, what would you like to know?"

 

Jaejoong's hand trembled at the blatant manipulation that Siwon did to Yoochun. He made the boy feel as though it was on his shoulders that his and Changmin's fate was going to be. However, he tried to rationalize that Leeteuk wouldn't be showing this tape at all if he didn't think it was worth their case. Turning back to the screen, Jae watched as Siwon began asking Yoochun questions.

 

"Do you remember the time when you entered the orphanage? Would it be okay if I asked about it?"

 

Yoochun shrugged. "After our parents died, Yunho hyung said that we needed to live in the orphanage because we were all minors. He said that it was only until he could find a job and make sure that we could all live together."

 

"Were you scared to move to the orphanage?"

 

"A little. At first I didn't really say a whole lot to the other kids there, preferring to keep to Changmin and myself. But that didn't last very long because it was only a few days until Junsu found me." Yoochun said with a smile as he remembered how the younger boy clung to him. And for the first time since his parents died, he actually smiled.

 

"Ah yes, Junsu is Jaejoong-shii's brother right?" Siwon asked.

 

"Yup! He really loves football and he's really good at it too." Yoochun said with flourish which made Jaejoong smile.

 

"And is that how you met Jaejoong-shii?" Siwon asked.

 

Yoochun nodded his head bobbing up and down so fast. "Yeah, Jaejoongie hyung came with Junsu one day and then he started playing with Changmin. And I was really surprised because Changmin didn't cry when Jaejoongie hyung picked him up. You see, none of the other sisters at the orphanage could pick Changmin up without him crying and Yunho hyung couldn't always be around because he had a part time job which meant that Changmin usually stayed with me. But then Changminnie, he liked Jaejoongie hyung and so I guess that's kind of how it happened." Yoochun said, his words coming into a rush, as he warmed to Siwon's questions.

 

"What happened?" Siwon asked.

 

"That's how we became a family." Yoochun murmurmed.

 

"A family?" Siwon asked.

 

Yoochun looked at him with the most sincere eyes as he nodded his head. "Yeah."

 

Siwon paused for a moment as he looked at Yoochun's face. Clearing his throat Siwon drew out a piece of paper and showed it to Yoochun. "Is this why you drew this for class?" Siwon asked showing Yoochun the drawing that got him in trouble with his classmates. It was the drawing he did for show and tell about what his family looked like where Yunho was the appa, Jaejoong was the eomma and him, Junsu and Changmin as the kids.

 

Yoochun took the piece of paper gently and smoothed out the curled edges. He began tracing the outlines of his family as a look of sadness took over his face. For a while Yoochun didn't say anything. He just kept staring at that piece of paper when suddenly big fat tear drops began to roll from his cheeks and drip onto the drawing.

 

Siwon looked surprised as he looked to the social worker for help. The lady stood up and walked over to Yoochun with a box of tissues and asked, "Yoochunnie do you want to stop?" She asked him gently.

 

Yoochun gave a little sigh then shook his head. "I... I'm sorry about this Siwon ahjussi." Yoochun said as he looked at the older man apologetically wiping at his tears with the back of his hand.

 

"W-Why are you crying Yoochun-ah?" Siwon asked.

 

Yoochun gave him a bitter smile. "Maybe... Maybe if I didn't make this drawing then things wouldn't have gotten to this." He said as he tried his best not to bawl his little heart out. Jaejoong on the other hand couldn't help himself as tears began to flow down his own cheeks. He could hardly stand the look of sadness on Yoochun's face as he watched the young boy blame himself. It took a lot for him not to ask the Bailiff to stop the tape.

 

"Why, what happened after you made this drawing?" Siwon asked.

 

Yoochun's face fell. "I didn't mean to get in trouble that day." Yoochun said in almost a whisper. "But I couldn't let them talk bad about my hyung." He said, his fists started to clench.

 

Siwon's eyebrows raised a little. Deciding to go in for the kill, Siwon began to lay out his own trap to show the court that Yunho wasn't fit to be a parent. "What about your hyung, Yoochun?"

 

"T-They said that he didn't have the right to raise my and my younger brother b-because he's g-gay." Yoochun said stumbling over the words.

 

"Is your brother gay, Yoochun?" Siwon asked gently.

 

Yoochun stopped and considered that question for a moment. Then he answered, "I don't know." He answered truthfully.

 

Siwon blinked. That wasn't the answer he was hoping for. But he persisted. "Have you and your Yunho hyung ever talked about his relationship with your Jaejoong hyung?"

 

Looking down on his feet, Yoochun nodded. "We have." He answered.

 

"What did your Yunho hyung have to say?" He asked.

 

"He said that he loved Jaejoongie hyung." He replied.

 

Siwon smiled. This was it. This was exactly where he wanted the case to go. "But then didn't you notice that maybe, just maybe your classmate was right? Because ever since your brother told you that, bad things started to happen to your family." Siwon said.

 

Yoochun didn't answer. Instead, he looked away. He couldn't really answer because it was the truth. Or at least it seemed like the truth. He didn't know. Suddenly he began to miss his mom a lot as he began to withdraw from the conversation.

 

But then Siwon said a statement that he would probably regret for the rest of his career. "Maybe things would have been better off if Jaejoong never got into your lives." He said.

 

Suddenly Yoochun blinked, his eyebrows furrowed. "No." He whispered.

 

"I beg your pardon?" Siwon asked.

 

"Y-Your wrong." Yoochun said as he gulped back the stream of tears that once again threatened to flow down his cheeks.

 

"What do you mean?"

 

"Do you have younger brothers or sisters Siwon ahjussi?" Yoochun asked.

 

"Why, yes." Siwon answered.

 

"Are your parents still alive?" Yoochun asked.

 

"Yes, they are."

 

"Are your parents straight Siwon ahjussi?" Yoochun asked, an unreadable expression on his face.

 

"I beg your pardon?" Siwon asked incredulously.

 

"Are your parents straight?" Yoochun asked.

 

Siwon shook his head refusing to answer when Yoochun said silently, "When my parents died, I didn't think I'd ever see my Yunho hyung ever smile again. He was always tired from work and even though he did his best, he wasn't the same hyung. And that made me feel like I was so alone. But I don't blame him because I know he tried to make sure that he could keep us three together. And then one day, two people came into our lives. One made me smile and the other made my hyungie smile. I didn't think it was ever going to happen again." He said in a rush.

 

When Siwon didn't answer Yoochun continued. "Ever since my parents died, there have been very little things to celebrate. We didn't have a lot of money but for the first time in a long while, we were happy." Yoochun said as tears began to fall down his cheeks again. But this time, he had a happy smile on his face.

 

"Jaejoongie hyung, he... he took care of Changmin and me. He didn't have to do that you know? Sometimes I was afraid that Junsu would become jealous of Changmin but he never did." Yoochun said.

 

"And when they said that we were going to be a family I was so happy because I didn't think that I would ever have that again." Yoochun said as he wiped at the tears that fell from his cheeks. "But you know what the best part was?" Yoochun asked the silent Siwon. "The best part was that Changmin had another person love him so much that it filled up all the places that Yunho hyung and I couldn't." Yoochun added.

 

Then facing Siwon with a maturity that belied his age he said, "And so if you ask me if it would have been better that Jaejoongie hyung never came into our lives? My answer would be no." Yoochun told the older man. "There are so few good things that have happened in me and my brothers' lives ahjussi. To refuse love even if it is from another man is just foolish. Why would I keep my younger brother from being loved by another human being?" Yoochun asked a now silent Siwon.

 

"My Jae hyung was right. Not a lot of people will understand. And so I do pity you Siwon ahjussi. And I pray for you that nothing ever happens to you and your parents that you couldn't be there for your dongsaengs so that they will never know what it's like to be alone in this world. But if something did happen that someone in the world would love them just like Jaejoong hyung loves us because I think that you have no idea what you're talking about."

 

Leeteuk stopped the tape as he looked around and smiled as he didn't think that there was a dry eye in the house. He looked at Jaejoong who smiled at him gratefully as he wiped at the tears that freely flowed down his cheeks. "The respondents rest your honor." He said.

 

The judge nodded and looked at Siwon who said that he had nothing further to add. The judge then rapped her gavel to dismiss the day’s proceedings and said that she will give her decision the next morning.

Hey all... I had crazy emotions while writing his chapter and the one that comes after this. Writing Yoochun's take had me in tears. I'd like to write more about how I feel about this chapter but I decided to write a loooong author's note at the end of this whole story. Please comment. I would really like to know what you think about all this.

I cannot believe that I’ve subscribed to this story for a very very long while but I’ve only started to read this yesterday! It is such a nice story and I lost count of the number of times I cried while reading but all in all, I’m so glad they found each other back! Thanks for the awesome story!

Chapter 33: Uuuh this powerful feel through the story.. cant stop the tears from flooding, You can feel the love from every moments of their live here T_T. The court scene esp portrayed realistically.. yunjae struggled with how society view their uality.. But honestly there is millions children out there who longing for bit of family warmth, and another millions who get abused even in their supposedly ideal straight parent! So it just disgusting how some people disregard the child's welbeing for their personal revenge toward gay or anything different going as far as to separate a perfectly happy family!! So really love yoochun for his words at siwon.. the world really need more this wisdom! Guess this will be one my most loved family fiction :) really adores yunjae domestic life as five whenever it is.. its so heartwarming in their younger days that as teenager yunjae able to put so much responsibility and affection for their brothers, honestly they were inborn to be umma&appa <3 and yeaaay finally they found minnie again! I think micky remember jae heck why he approach him, but to think about it changmin just toddler when they are separated lol.. well hope yunjae and their children have it fate in their favor this time they really deserved all happiness and fluffiness in the world :D <3 <3 <3 <3 <3

This is a really nice story, although it's angst. There's still fluff in it. <3 Love this fic, it was worth reading it.
