“Good morning ladies and gentlemen, this case involves the Attempted Murder and Robbery charges submitted before by the camp of Mr. Oh Sehun against Ms. Jung Soojung. The plaintiff, Oh Sehun, has accused Jung Soojung of attempting to end his life because of a misunderstanding and failed robbery. The court of Judge Choi Seungho has ruled before that the defendant, Jung Soojung, was guilty beyond reasonable doubt and was sentenced to serve 5 years in prison. The camp of Jung Soojung has requested for the re-opening of the case due to the mistrial allegedly given to the defendant. I would like to call the lawyers of both camps to approach me here in the front for a short introduction.”

Both lawyers went to the Judge and had a little talk that ended with a handshake before going back to their respective seats. The courtroom was quiet while they wait for the start of the opening statement.

Judge Cho cleared his throat and called on the side of the defendant and the plaintiff “Are both sides ready?”

“Ready your Honor.”

“Atty. Kim Jongkook, please give your opening statement…”

The lawyer Kim stood up and went in front to start his statement. I swear I really want to slap that smug face of him.

“Your Honor, Ladies and Gentlemen. The defendant has been charged with the crime of attempting to murder my client because of a failed robbery. She was proven guilty before by the Court due to the evidences we have duly submitted. We do hope that this re-trial be closed within today because there is no reason to open a fresh wound and add another one. The case has brought distress and depression to my honorable client who was nice enough that night to give attention to her, even physical pain that until now he is suffering from it as you can see. I hope that everything will be settled today and for the defendant to accept her fate. Thank you..”

After that good for nothing statement from that smug , the Judge turned his attention to Yuri and Atty. Liu to start their statement. Yuri stood up, looking so smart and confident in her ladies suit. She said its her favorite suit because it always gives her victory when she wears it. She took the front and presented herself confidently like what she was doing last night in front of Mickey Mouse.

“Your Honor, Ladies and Gentlemen. I am here today to give light on the mistrial that was given to my client Jung Soojung. She was presumed guilty even though she pleaded not, and was given a verdict that was not deserving due to the alledge ‘concrete evidences and witnesses’. I am here today to prove to all of you that my client Jung Soojung is innocent of the charges filed against her, that the ‘evidences and witnesses' the plaintiff’s side presented in the Court before were fake or a sham. I am here to prove to everyone in this Court that the plaintiff Oh Sehun is not the person we thought he is as presented by his honorable lawyers. That the reason for my client to harm Oh Sehun was a mere act of fighting for her life and survival. I hope that by this day ends, my client Jung Soojung be proven innocent of the crime thrown against her and the true culprit be prosecuted and sentence for the crime he did. Thank you very much your Honor.” Yuri bowed at him and to the audience before going back to her seat.

The way she presented herself was so confident and her voice full of authority, she wasn’t the Yuri I saw this morning going out of her bathroom after puking. She transforms into another character when she’s in court and I admire her for that. This is the first time I’ll be seeing her like this.

Judge Cho nodded at her turned to the other camp, the lawyers all smirking and confident that they will win this again. Thinking that we just brought my sister in a double jeopardy. They really didn’t know that we have the goods…

“The camp of the plaintiff may call their witness if there are any.”

“None, Your Honor. All witnesses and evidences has been presented before in the court based on the report we have submitted and the court files you have. The defendant’s side can now start their presentation, Your Honor.”

“Very well, if that is your desire then I will let you.” Judge Cho turned to Atty. Liu and asked him in a kind voice “The camp of the defendant may call their witness if there are any, Atty. Liu?”

Atty. Liu stood up and went to the front to give his piece. “We are presenting some witnesses and newly found evidences that will claim that our client is innocent of the crime. Your Honor, these witnesses are willing to testify to shed some light on the shameful act of the plaintiff’s camp to bury the truth and slander my client.” Atty. Liu motioned to the Court Clerk to call their first witness.  

“The Court would like to call the first witness of the defendant’s side. Please take the witness stand, Mr. Daniel Kang..” the door of the courtroom opened and revealed a young twenty-something guy wearing a black suit being escorted by Mr. Zhang’s men and the Court Sheriff. I snickered at Atty. Kim who was looking like a pathetic mouse when he heard the name of our witness. Oh Sehun’s team of lawyers are all fixing their tie trying to look cool but all of them look nervous.

Who is Daniel Kang and why are they acting like that?

We’ll see.

Daniel Kang took the witness stand facing the gallery without any trace of fear on his face. The Court Clerk approached him and started to ask him to swear.

“Please raise your right hand. Do you promise that the testimony you shall give before this Honorable Court shall be the truth, the whole truth, and nothing but the truth, so help you God?”

“I do.”

“Please state your first and last name.”

“My name is Daniel Kang.”

“Please be seated.”

Atty. Liu went to his side and gave him an assuring smile. “Mr. Daniel Kang, please do enlighten us with the type of work you had before…”

He nodded like an obedient child and started his statement. “I was a CCTV operator at the Seoul Police District before I went into hiding. I was hired to monitor the CCTV cameras installed on the streets particularly at the Cheongdamdong area.”

“Where were you the night when the crime happened?”

“I was in my usual duty sir which is from 10:00 in the evening til 6:00 in the morning the following day.”

“Could you tell us what happened in your duty that night?”

“Yes sir… my shift started peacefully while we monitor the streets. By the wee hours of the morning around 1:00 to 1:30 am I chance upon the monitor to see a group of persons standing near an actual crime happening. I checked the location of the camera and found out it was located in a lamp post just beside the Dance Club at Cheongdamdong. When I zoomed the camera, I saw that a guy was actually having a girl beneath him. The girl was fighting the guy and hitting him but the guy suddenly punch her in the stomach resulting for her to stop what she was doing. I alerted the police officers about it and gave them the location for them to help the victim.”

“This guy you were saying, is that guy here inside the court room today?”

“Objection your Honor! The question is misleading!” what?!

“Objection overruled. Please do continue..”

Atty. Liu bowed to the Judge and asked Daniel Kang again. “Again Mr. Kang, could you please identify the guy you have seen that night in the CCTV footage where you witness the crime that was happening?”

“Yes sir, it’s him..” He pointed at Oh Sehun who was just staring at him without any emotions. “He had an orange color hair back then and he was wearing a floral shirt. After punching the girl in the stomach, I saw from the footage that he pulled her pants down. That’s where I panicked because I was afraid of what’s going to happen to her.”

"Does the girl even look like she was committing a robbery crime to the person on top of her?"

"No sir, because from the start it was the guy who attacked her and made her fall down on the ground." 

My sister was just listening to his statement with her head down. I’m really worried right now for her because it brings back bad memories of that night. Yuri patted her back gently and whispered something on her, she nodded and continued on listening.

“So you mean, after you alerted the police about the crime that was happening… you continued to view the footage Mr. Kang?”

“Yes , sir. Because I want to monitor if the police has arrive on the scene of the crime and stop it from happening. But seeing it from the screen… I guess they were too late…” he has this sad voice when he said the last sentence and took a glance at my sister Soojung who has her head down.

“What do you mean that they were too late? What have you witnessed Mr. Kang?”

He took a deep breath and answered Atty. Liu’s question in a sad voice “The guy on top of the girl has succeeded in the girl beneath him. She wasn’t moving that time so I suppose she lost control of her consciousness. He has his pants down a little and was moving in a like motion with his hips. Our CCTV cameras on our streets are in High Definition and with Night vision so even if it is dark on the street the feed is still clear and vivid.”

“Objection your Honor! The witness cannot be so sure on what he has seen. It was night time and how can he say that my client the victim when they don’t have any proof that it was  as it was unproven on the dismissed case filed against him by the defendant.”

The Judge turned to Atty. Liu and asked him “Atty. Liu, the claim of the witness is somehow hard to prove judging from the decision before when the case was dismissed. Do you have any evidences to prove it?”

Atty. Liu gave him a small smile and nodded before looking back at Atty. Kim who was standing behind their table, his jaws clenching. “I have, your Honor.” Yuri stood up and gave a USB dongle to her father.
