Music Plagiarism: According to urban legend, a songwriter is allowed to copy not more than four bars from another song.

 

But according to the US Copyright Office,  "There are no legal rules permitting the use of a specific number of words, a certain number of musical notes, or percentage of a work. Whether a particular use qualifies as fair use depends on all the circumstances."

So the original songwriter can decide whether his work is plagiarized. He has the right to decide how much can be taken from his work or how much of the original can be altered.

I read the definition of copyright in South Korea but it doesn't specify the number of notes or bars as well. And in the court ruling of JYP's plagiarism case,
 
Under Korean copyright law, a claim for plagiarism and copyright infringement is established when the defendant had access to the copyrighted work of the plaintiff and there exists a substantial similarity between the two works.  With regard to the first element, the access does not mean an actual access.  Rather, just a reasonable possibility of access is sufficient to meet that element.  In similar cases, Korean courts have presumed and acknowledged the accessibility in a situation where the plaintiff’s song was publicly available and widely disseminated.  The next element, a substantial similarity is quite difficult to establish.  Korean courts have set the basic rule that, when deciding the substantial similarity in musical compositions, the court should consider every component of the song with special emphasis on the melody part and this comparison shall be done on both quantitative and qualitative levels and reviewed by the perspective of ordinary observers.
 

 

I also came across this statement from that same article: "The Court found that four bars from the chorus of the defendant’s song is substantially similar to that of the plaintiff’s song which constitutes a copyright infringement and ordered the defendant to pay approximately 20,000 USD to the plaintiff as a remedy."
 
Four bars were copied and he was charged of plagiarism. 
 
 
So did TS Ent plagiarize Shinhwa's song?
 
Well, if we base it on the ruling of JYP's plagiarism case, if at least four bars [note: the minimum number of bars or notes allowed to be copied wasn't specified, so this is just an example] of BAP's BADMAN is similar to that of Shinhwa's We Can Get It on, even if the tempo is different [note that emphasis is placed on the melody], then TS Ent might be guilty of plagiarism. 
 
 

TS, "We are aware of there being talks about the similarities between the two songs. The song was not plagiarized and we don't feel that it was worth responding to so we never released a statement on the issue. It is the same for 'No Mercy'. If people consider this plagiarism, then A Pink's 'No No No' and S.E.S. should be plagiarism as well. There are a lot of similar songs these days. We feel that these accusations are coming from Shinhwa's fandom."

Shinhwa Company, "We are aware of there being talks about the similarities between the two songs. However, Shinhwa is currently on break after their Asia tour so we will have to check in on the matter with them."

I am not a lawyer, I merely presented what I've read and my statement is purely based on the JYP case. Note that I am not claiming anything. I am merely trying to understand how SK handles music plagiarism. Don't go mental on me. I would never wish harm on the boys. It's their company's fault.

i find it highly amusing and shinhwa-style for them to release a statement saying that they are on vacation and will deal with it later; which means that they aren't too concerned about it and if anything is going to happen then they would prob handle it privately

shinhwa fans on tumblr are having fun with shinhwa's response; i've seen a few gif sets emphasising the "on vacation" response.

TS Ent made a rash decision, releasing a statement like that. But in reflection to the truth regarding lots of songs that sound similar, shouldn't the laws be amended so that there would be a clear basis on whether or not a certain case is considered plagiarism?

Shinwa has been on the entertainment field for a long time, and they know more about this things. They are being Hyungs/Sanbaes that are looking out for their younger brotheren, but now they are being forced to look into it more deeply.

I like BAP but TS doesn't seem to be handling this very well. The statement, as you said, should have ended after the second sentence. No need to start blaming the fandom -.-
